1. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use our Services.
By using InstaReviewUs, you represent that:
You are authorized to act on behalf of your business.
The information you provide is accurate and complete.
You will comply with all applicable laws and regulations.
2. Description of Services
InstaReviewUs provides a customer feedback and review funnel system designed to:
Direct satisfied customers to public review platforms (e.g., Google)
Collect private feedback from dissatisfied customers
Provide analytics and reporting
Offer optional coupon delivery features
Provide AI-assisted or managed review responses (depending on plan)
We do not control third-party platforms such as Google, Yelp, or Facebook and are not responsible for their policies or actions.
3. Account Registration
To use our Services, you must create an account.
You agree to:
Maintain the confidentiality of your login credentials.
Notify us immediately of unauthorized access.
Be responsible for all activity under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans & Billing
A. Pricing
Subscription fees are billed according to the plan selected (e.g., Basic, Pro, Ultimate). Pricing is subject to change with notice.
B. Payment
Payments are processed through third-party providers. You authorize us to charge your payment method on a recurring basis. Failure to pay may result in service suspension.
C. Cancellation
You may cancel your subscription at any time through your dashboard.
Stops future billing.
Does not retroactively refund past payments unless otherwise stated.
5. Refund Policy
Unless otherwise stated in writing:
Subscription fees are non-refundable.
Promotional offers or free trials may have separate terms.
6. Acceptable Use
You agree not to:
Use the Services for unlawful purposes.
Violate Google or other third-party platform policies.
Misrepresent customer feedback.
Submit fake reviews.
Use the system to harass or defraud customers.
Interfere with platform security.
You are solely responsible for ensuring that your use of incentives complies with applicable review platform guidelines.
7. Customer Data & Responsibility
You are responsible for:
Ensuring you have proper consent to collect customer contact information.
Complying with privacy, SMS, and data protection laws.
Managing how you use collected feedback.
InstaReviewUs acts as a service provider and does not assume ownership of your customer data.
8. Managed Response Services (If Applicable)
If you subscribe to a plan that includes managed review responses:
Our team may respond to negative reviews or private complaints on your behalf.
You remain ultimately responsible for your business decisions and communications.
We are not liable for disputes arising from responses.
9. Intellectual Property
All content, software, branding, design, and technology provided by InstaReviewUs remain our exclusive property.
You may not:
Copy, reproduce, or reverse engineer the platform.
Resell the Services without authorization.
Use our branding without written permission.
10. Third-Party Integrations
Our Services may integrate with third-party platforms including:
Google
Yelp
Facebook
Zapier
SMS providers
Payment processors
We are not responsible for platform downtime, API changes, or account suspensions by third-party platforms.
11. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
We do not guarantee:
Specific increases in review count.
Improved star ratings.
Continuous uninterrupted service.
Acceptance or approval by third-party platforms.
To the fullest extent permitted by law, we disclaim all warranties, express or implied.
12. Limitation of Liability
To the maximum extent permitted by law:
InstaReviewUs shall not be liable for indirect or consequential damages.
Lost profits or revenue.
Business interruption.
Reputation loss.
Third-party platform penalties.
Our total liability shall not exceed the amount paid by you in the preceding 12 months.
13. Indemnification
You agree to indemnify and hold harmless InstaReviewUs from claims arising from:
Your misuse of the Services.
Your violation of laws or third-party policies.
Customer disputes.
Content submitted through your account.
14. Termination
We reserve the right to suspend or terminate access to the Services if:
You violate these Terms.
You fail to pay subscription fees.
We suspect fraudulent or abusive activity.
15. Governing Law
These Terms shall be governed by the laws of the State of Illinois, without regard to conflict of law principles.
Any disputes shall be resolved in the courts located in Cook County, Illinois.
16. Changes to These Terms
We may update these Terms at any time. Changes become effective upon posting. Continued use of the Services constitutes acceptance of updated Terms.
